1.Who we are
Kijani (“the Service”) is provided by [LEGAL COMPANY NAME], registered at [COMPANY ADDRESS] (“we”, “us”). You can contact us at [CONTACT EMAIL].
These Terms apply to everyone who creates a workspace or uses the Service on behalf of a workspace (“you”). By ticking “I agree” when you sign up, or by using the Service, you accept these Terms and our Privacy Policy.
2.Your account
- Account creation: you need a valid email address, phone number and company name to create a workspace. [MINIMUM AGE OR BUSINESS-USE REQUIREMENT TO BE CONFIRMED].
- Accurate information: the details you give us, and the business profile you describe to the AI, must be true and kept up to date.
- Account security: keep your password private, and turn on two-step sign-in. You are responsible for activity in your workspace, including by team members you invite.
- Your responsibility: the person who creates a workspace confirms they are authorised to accept these Terms for the business it represents.
3.Using the Service
You may use the Service to find businesses that may need what you sell, research them from public information, write and send messages from your own connected accounts, create and publish content to your own social pages, answer conversations and keep track of your sales work — in line with these Terms, the Acceptable Use Policy and the Messaging & Anti-Spam Policy.
4.What you must not do
You must not use the Service for, or to help with:
- Spam or indiscriminate messaging, phishing, fraud or deceptive practices.
- Harassment, threats, hate or abusive campaigns.
- Impersonating any person or organisation, or misrepresenting who you are.
- Illegal activities, or promoting illegal goods or services.
- Unauthorised access to systems or accounts, or distributing malware.
- Abusing or circumventing the rules and limits of email, WhatsApp, social networks or other third-party services.
- Collecting or using personal information without a lawful basis.
The Acceptable Use Policy describes these rules in more detail.
5.AI-generated content and actions
The Service uses AI to write messages, research businesses, create content and, if you allow it, act for you — for example sending messages, replying to conversations, following up and publishing posts.
You decide what the AI may do. You set its instructions, permissions, approval mode, limits and connected accounts, and you are responsible for configuring and supervising it, and for what is sent or published from your accounts.
AI output can be wrong. Review important content before it is sent. See the AI & Automation Policy.
6.Third-party services
The Service works with services run by others, such as Gmail, WhatsApp, Facebook, Instagram, TikTok, YouTube, Telegram, map and search providers, and AI model providers. Your use of them is also governed by their own terms and limits, which can change, and which may restrict or suspend your accounts there. We are not responsible for those services or for actions they take on your accounts.
7.Intellectual property
You keep ownership of the content you upload and of the information about your business. You give us the rights needed to store and process it to provide the Service to you.
Content the AI creates for you is provided for your use. [OWNERSHIP AND LICENCE OF AI-GENERATED OUTPUT TO BE CONFIRMED]. You are responsible for making sure content you publish does not infringe the rights of others.
The Service itself — its software, design and brand — belongs to us or our licensors.
8.Payments and subscriptions
Some features or usage levels may require a paid plan. Plan prices and allowances are shown in the app before you pay. Payment is made by mobile money to the payment number shown in the app, and a plan period starts when we confirm your payment. Plans do not renew or charge you automatically.
See the Refund & Cancellation Policy. [PRICING, TAX AND INVOICING TERMS TO BE CONFIRMED].
9.Suspension and termination
We may warn you, pause sending, suspend agents or campaigns, restrict, or close a workspace that breaks these Terms or our policies, puts others at risk, or is required to be stopped by law. [NOTICE AND APPEAL PROCESS TO BE CONFIRMED].
You can stop using the Service at any time, and the workspace owner can delete the workspace in Settings → Privacy & data.
10.Disclaimers
The Service is provided “as is” and “as available”. We do not guarantee leads, replies, sales, revenue, deliverability, or that AI output is accurate or complete. [DISCLAIMER WORDING TO BE REVIEWED UNDER THE GOVERNING LAW].
11.Limitation of liability
[LIMITATION OF LIABILITY CLAUSE, INCLUDING ANY CAP, TO BE DRAFTED BY A LAWYER].
12.Changes to the Service and these Terms
We may change the Service. When we change these Terms in a way that requires your agreement, we will ask you to agree to the new version the next time you open the app, and we keep a record of which version you agreed to.
13.Governing law and disputes
These Terms are governed by [GOVERNING LAW]. [DISPUTE RESOLUTION PROCESS AND VENUE TO BE CONFIRMED].
